Probate & Trust Administration

When an individual passes away, a Personal Representative (PR), often a loved one, is given the authority to manage that person’s assets. The PR must pay the decedent's debts and distribute assets according to a will. This court-supervised legal process is known as probate. Massachusetts offers several types of probate, and the Law Office of Chantal Hayes Rice, Esq. can help determine which type of probate suits your circumstances. Here’s a brief overview of the probate options:


  • Voluntary Probate is available when the decedent had no real property and less than $25,000 in personal assets.


  • Informal Probate is suitable when there is no will or when the will is unlikely to be contested, allowing the PR to perform duties without strict reporting requirements, provided all parties consent.


  • Formal Probate occurs when court supervision is necessary for asset distribution, requiring the Personal Representative to file inventory and accounting records for the court's review. Will & Trust Contest

Heirs, beneficiaries and other interested parties may file a lawsuit to contest a will or a trust. There are several reasons that a will or trust may be contested such as the lack of capacity of the deceased person or grantor, the undue influence of a third party or a mistake in the document. There are very strict statutes of limitation on these claims so please contact our office for a free consultation if you would like to discuss your rights and the likelihood of success.
Guardianship & Conservatorship

Petition to Partition

When co-owners of real property are unable to agree on whether to sell or retain real property, any of the owners can file a petition to partition to request a judicial (or forced) sale of the property. This situation often arises when siblings inherit real property or when unmarried co-owners disagree on a buyout or sale after a break-up. This process involves the appointment of a commissioner to sell the property which increases the cost to the parties. Mediation is strongly encouraged if parties are facing a partition proceeding to save on time, costs and to achieve optimum results for the parties. Estate & Trust Mediation

Mediation is a process whereby the parties agree to hire a skilled and neutral mediator to help the parties resolve the case in an effort to avoid a trial. Mediation is particularly useful in a will or trust contest case, contested guardianship or conservatorship and in partition of real estate cases.
